Common law trusts have been increasingly popular for Asian families in their succession and estate planning. Clients are often attracted by the flexibility and asset protection features of trusts but also find it difficult to relinquish control at the thought of passing significant family wealth to a structure legally owned by a third party and recent cases have reminded us that the flexibility of trusts is not unlimited. If you are a trusted advisor of a HNW family, have you ever wondered in what circumstances giving in to client's desire to retain control might render the trust vulnerable? What level of oversight should the settlor have over the trust without putting the validity of the trust at risk? What are the limits on the exercise of a power that has the effect of amending the terms of a trust?
In this panel discussion Stephenson Harwood's top ranked contentious trust practitioners will draw on their ample experience in representing trustees and families in a variety of trust dispute cases and share their insight and practical tips on how to avoid pitfalls in structuring family trusts.
